Consignment Agreement
You (“the Consignor”, “You” or “Your”) have read Sharing Sunshine LLC ( “Our”, or “Us”) Consignment Contract. I understand that by providing my items to Sharing Sunshine LLC I am agreeing to the commission and terms of this Consignment Contract. I agree to all of the Terms and Conditions outlined below.
A. Process - Currently we are focused on items for both boys and girls, sizes newborn to 16. We also accept shoes in new, like new, and excellent condition, but no other accessories at this time. Upon receipt of your item(s) Sharing Sunshine LLC will be responsible for the promotion and customer service to sell, including: resale market price evaluation, detailed description, photography, online posting, in-person sales, social media and email promotion, answering customer inquiries, secure packing, and shipping and/or delivery, or pick up of item. We will take all necessary steps to sell your item(s) quickly and at the best price possible. Items will be sold in a variety of formats, including, but not limited to website, social media (live sales, story sales, posting, etc.), shopping appointments and in-person shopping locations or events. Sharing Sunshine LLC reserves the right to determine which methods are used and in what time frame of consigned items. We reserve the right to accept or reject an item for any reason including quality- general wear of the item, fading of colors, age of item, stains or holes, unaccepted brand, or based on consumer interest. Some brands, such as Tea Collection and Hanna Andersson, if some items have significant wash fading or layette or swim items with notable piling will therefore not be accepted due to consumer expectations of quality. Shoes will only be accepted if in new or like new condition. Sneakers and shoes with obvious wear, scuffing and staining, will unfortunately not be accepted due to customer expectations and interest.

As well as other high end children’s clothing brands, including:
Janie and Jack, Kyte, Quincy Mae, Smocked clothing companies, Cecil and Lou, Little Sleepies, Lilly Pulitzer, Vineyard Vines, Ralph Lauren, Boden, Hanna Andersson, Nordstrom, Tucker and Tate, Athleta girls, Ivivia, Shrimp and grits, Smockingbird, Zuccini kids, Alice and Ames, Lou Lou and company, Hannah Kate, and Tea Collection, UGG, Natives, Edgehill collections.
C. Clothing brands not accepted at this time to limit volume and provide consistent quality and pricing: Gap, H and M, Old Navy, Nautica,Tommy Hilfiger, Cat and Jack, Gymboree, Athletic apparel- Nike, Under Armour, Adidas, First impressions, Little me, Burts Bee’s, Children’s place, Osh gosh, Jumping beans, Wonder nation, Garanimals, Hallmark baby, and other Buy Buy baby brands and other brands found frequently sold at discount stores such as Marshalls and TJMaxx- good lad, Jessica simpson, Izod, etc. We also do not take weighted sleep sacs or swaddle sacs at this time- only basic sleep sacs such as Kyte baby.
D. Pricing - Sharing Sunshine LLC. will research extensively and price items at the current fair market/resale value. All list prices are determined at our sole discretion. Items will be discounted to 20% off at 60-90 days depending on item and interest and potentially further for best chance of sale.
E. Unlisted items: Items not able to be listed for sale by Sharing Sunshine LLC, due to stains, holes, overall wear, brand on unaccepted list, or an undesirable/dated style- these will be donated. Please understand, consignor will not be notified of what is and not accepted due to amount of time required of this task. There is no option for return of items deemed unsellable.
F. Consignment Period and Donation Policy - All items are consigned for a minimum of 6-12 months, however may be listed longer to allow a full applicable season for purchase (such as winter or spring/summer). Unsold items will be either returned or donated at the end of the consignment period, based on consignor’s donation declaration. Items can be picked up or shipped at owner’s expense at the end of the selling period. To have items returned, a $20 fee will be charged, for up to 20 items to cover employees processing time, supplies and storage of items until pick up. Guarantee return of all items is provided with an itemized inventory list by consignor, when receiving consigned items. Failure to pick unsold items, or communicate with Sharing Sunshine LLC, within a week of your unsold items notification email, will result in donation of your items to partner charities.
G. Payouts - Consignor sales spreadsheets are emailed on the 1-3rd of each month, reflective of the previous month’s sales. This date may vary up to 48 hours based on holidays or other circumstances, in which the consignor will be notified by Sharing Sunshine LLC. Payouts are issued within 48 hours of consignor sale spreadsheet email, via Venmo. Payout percentage includes all fees associated with the sale of the item (which may include standard item markdowns over time or company sales). Consignors will receive 40% of the item’s final sale price.
H. Condition of Items - Any repairs needed will be deducted from the consignor’s payout for the item. Repair of items, such as button replacement, will only be an option for boutique and highly desired items.
I. Cancellation of Consignment - Taking into account the time and energy invested into each listing, there will be a $50 cancellation fee, plus shipping costs to return your items before the end of a consignment period (365 days per drop off). A 7 day notice is required for pick up of items after a cancellation of consignment. Items will be picked up by consignor or shipped at their cost.
J. Limitation of Liability - Sharing Sunshine LLC will take diligent care of the consigned pieces as to the best of its ability and while we take every precaution to protect your items against loss and/or damages while they are in our care, Sharing Sunshine LLC is not responsible in the event of theft, fire, flood or act of nature while your items are in our possession. This includes any damage caused by a customer, fire, flood, earthquakes, stains, tears, missing pieces, damage caused during shipping, or any other damage with no exclusions of man made or natural damages to consigned items.
Our Terms and conditions are located at on our website www.sharingsunshinekc.com, and are incorporated by reference and made a part of this Agreement to which You are agreeing, and such Terms and conditions additionally apply to any of Your and Our activities under this Agreement.
Legal Right to Consigned Items. Consignors guarantee that all items consigned to Sharing Sunshine LLC. for sale are lawfully and entirely owned by me or I am acting on behalf of a person(s) who have given me the authority to sell such items on their behalf. I guarantee to indemnify Sharing Sunshine LLC. for any damages, penalties, fines, fees or judgments for any issue arising due to the rights of the lawful owner of the merchandise being placed on consignment.
By allowing pick up, drop off or shipment of Your items to Sharing Sunshine LLC, (including future item drop offs or pick-ups) I certify that I (“the consignor”) fully understand and agree to all of the Terms and Conditions in this Consignor Contract. I also state that all information on this is true and correct.
